Procedure: Our Approach

  1. Initial Legal Consultation: Review the lease agreement and the nature of the breach and advise you as to the potential grounds for breach of contract and eviction proceedings in Turkey.
  2. Legal Basis: Evictions are primarily regulated by Articles 315, 316, and 352 of the Turkish Code of Obligations. These articles outline the conditions under which a landlord can terminate a lease and proceed with eviction.
  3. Issuing Notices: Depending on the reason for eviction, landlords may need to send one or two notices to the tenant. For non-payment of rent, Article 352 of the TCO requires two justified warnings within the same rental year before proceeding with eviction​​​​.
  4. Issuing a Notice: The eviction process can begin with the landlord issuing a notice to the tenant for reasons such as non-payment of rent. Depending on the situation, a notice period of at least 30 days is typically required before further legal actions can be taken.
  5. Legal Proceedings: If the tenant fails to rectify the breach within the notice period, the landlord can proceed to file an eviction lawsuit. Eviction cases are usually heard in peace (Sulh) or enforcement (İcra) law courts, with the choice depending on the complexity and nature of the eviction.
  6. Execution of Eviction: Following a court's eviction order, the actual eviction is carried out through a formal process involving court officials to ensure it complies with legal standards.
